Protecting your privacy is really important to us. Accordingly, we are providing this Privacy Policy to explain our practices regarding the collection, use, and disclosure of personal data and other information that we receive when you use our website(s) located at https://atidiv.com/(the “Site(s)”), and our Services available via the Sites. “Services” shall have the meaning ascribed to it in the terms of service available at Website Terms and Conditions. This Privacy Policy does not apply to any third-party websites, services or applications, even if they are accessible through our Services. We are the data processor of personal data and our customers are the data controllers. Throughout this document, the terms such as “Atidiv India Pvt. Ltd.”, “we”, “us”, and “our” refer to Atidiv India Pvt Ltd.

Information We Gather

Our primary goal in collecting information is to provide Services and improve them, to administer your use of the Services, and to enable you to enjoy and easily navigate our Services.

When do we collect information?

Information collected through our website: We collect personal data when you use our website/services, such as the contact us form, or the personal data provided directly to us. Like, Full name, Email ID, Company name etc.

Information collected during the hiring process: We collect personal data when you apply for job openings at Atidiv India Pvt Ltd. Like, Name, Email Id, Contact No., CV, DOB and Employment Experience, Education Certificates 

 Information collected from you as an employee: We collect your personal data when we onboard you as an employee, and to perform other activities as part of employment, Name, email ID, contact details, date of birth, PAN card, Aadhaar card, address, bank account details, photograph, KYC data, employment history, education details, salary structure, designation, PF and ESIC registration details, nominee information (including nominee’s name, PAN and Aadhaar number)

Information collected at the office: We collect your personal data directly from you when you visit our office. We also have CCTVs placed to monitor the premises.

Information collected from a vendor or a client:  We collect your personal data when we onboard you as a vendor or client, and for performing activities as per our contract. Information collected may include details such as name, email ID, organization or company name, and other professional contact information.

What information will we collect?

Information Provided by you:

Information collected from our clients and vendors: name, email address, company/business details, phone number. 

Information collected through our employees: Name, Email ID, Contact No., Date of birth, Blood Group, date of joining, designation, Employment history-salary slips, relieving letter, offer letter, address proof, passport copy, government ID, photographs, UAN, previous PF account number, family and minor details like name, contact number, email, biometric data, and education details. 

Information collected to interact with the sales and marketing team: When users want to interact with the sales marketing team, then, their Name, Email ID, contact number and Organisation Name are captured. The collection of information also depends on the Account Holders as whatever details they wish to capture to connect with the user are captured from the conversation on the above-mentioned platforms

Information collected through our website:

Information Collected from the website Let’s Talk / Contact us section: We collect Company name, email address, phone number, and the message that you share with us.

Information Sent by Your Device: We collect certain information that your device sends when you use our Services, like a device identifier, user settings, and the operating system of your device, as well as information about your use of our Services.

Log Data: Our servers automatically record certain information about how a person uses our Services (we refer to this information as “Log Data”), including both Account holders and non-Account holders (either, a “User”). Log Data may include information such as a User’s Internet Protocol (IP) address, browser type, operating system, the pages or features of our Services to which a User browsed and the time spent on those pages or features, the frequency with which of our Services are used by a User, search terms, the links on our Services that a User clicked on and other statistics. We use this information to administer the Services and we analyze (and may engage third parties to analyze) this information to improve and enhance the Services by expanding their features and functionality and tailoring them to our Users’ needs and preferences. We also use the IP Address to generate aggregate, non-identifying information about how our Services are used. Please note that during this, at no point in time do we collect and/or share PII collected with any third parties.

Information Collected through our Product: We collect certain information such as name, email address, phone number, online identifiers such as IP addresses, cookie identifiers, device IDs.

Location Information: In some cases, we collect and store information about where you are located, such as by converting your IP address into a rough geolocation or through our Product.

Other Data: Apart from data that you provide us directly, we also may collect information about you from publicly available sources and third-party sources like professional network sites, Booking Management Systems, Hospital Management Software, etc.

Lawful Basis for Processing

We at Atidiv India Pvt. Ltd. process the personal data if we have a lawful basis. Our lawful basis is as follows:

Consent: We process your data only if you have given your consent freely for the same.  Where you have consented to a particular processing, you have a right to withdraw the consent at any time. You may withdraw consent by contacting us with a request using the details set out in the “Contact Information” section below.

Contractual necessity: We process your personal data only when it is necessary for the performance of a contract. For example, if the processing is necessary in order to fulfil our commitments under the applicable terms of service.

Legal Obligation: We process your data only if the use of your information is necessary for compliance with a legal obligation.

Legitimate Interest: We process your data on the grounds of legitimate interest for example, to provide our Services, and to monitor the performance of the products/Services.

Where the processing is based on your consent, you have the right to withdraw your consent at any point in time. Please note that should the withdrawal of consent result in us not being able to continue offering our Services to you, we reserve the right to withdraw or cease our Services to you upon your withdrawal. You may withdraw consent by contacting us with a written request to the contact details specified below in the ‘Contact Us’ section. Upon receipt of your request to withdraw your consent, the consequences of withdrawal will be communicated to you. Upon your agreement to the same, your request for withdrawal will be processed.

How will we use your information?

We use the information provided by you in the following ways:

  • To monitor and check the performance of the product;
  • To perform the contract, we have signed with our customers, suppliers or partners;
  • To onboard you as an employee;
  • To expand our products and Services;
  • To help protect your information and prevent unauthorised access to it;
  • To onboard you as a vendor or a client
  • To monitor our premises and track visitors through CCTVs and the visitor register

Our Policy Towards Children

11.1. We recognize the importance of children’s safety and privacy. Our Services are not directed to children under 16 and we do not knowingly collect personal data II from children under 16. If we learn that we have collected the personal data II of a child under 16 we will take steps to delete such information from our files as soon as possible or if a parent or guardian becomes aware that his or her child has provided us with personal data, they should write to us and we will delete the same.

Any such disclosure shall be in accordance with any and all legal requirements applicable.

Information Disclosed for Our Protection and the Protection of Others

We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to the government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate: (i) to respond to claims, and legal process (including subpoenas); (ii) to protect our property, rights and safety and the property, rights and safety of a third party or the public in general; and (iii) to stop any activity that we consider the illegal, unethical or legally actionable activity.

Information We Disclose with Your Consent or at Your Request

We will share your personal data with third-party sites or platforms if you have expressly requested that we do so.

Information disclosed with our Professional Advisors. 

We will share personal data with our professional advisors who advise and assist us in enforcing our contracts and policies, handling our claims, effective management of our company and in relation to any disputes we may become involved in.

Information disclosed with our Group Companies

We will share personal data with our group entities and the companies that we will acquire in the future when they are made a part of our group entities to provide and improve our Services

The Security of Your Information

We take reasonable measures to protect the information that we collect from or about you (including your personal data) from unauthorized access, use, or disclosure by encrypting all data while stored and in transit via our Services, including User information, messages, and any Content attached to the messages. 

All personal data provided by you will be stored in a secure environment, protected from unauthorized access, modification, or disclosure.

Links to Other Sites

Our Services may contain links to other websites and services. Any information that you provide on or to a third-party website or service is provided directly to the owner of the website or service and is subject to that party’s privacy policy. Our Privacy Policy does not apply to such websites or services and we’re not responsible for the content, privacy, or security practices and policies of those websites or services. To protect your information, we recommend that you carefully review the privacy policies of other websites and services that you access.

International Transfer

4.1. We mainly process personal data in the United States and India. However, we may transfer personal data outside the United States and India and we will ensure that the recipient of your personal data offers an adequate level of protection that is at least comparable to that which is provided under applicable data protection laws.  

4.2. If you are a resident of the European Economic Area and when your personal data is processed outside EEA, we will ensure that the recipient of your personal data offers an adequate level of protection, for instance by entering into standard contractual clauses for the transfer of personal data as approved by the European Commission (Article 46 General Data Privacy Regulation, 2016), or we will ask you for your prior consent to such international data transfers.

Data Retention

We will retain your personal information for as long as is needed to fulfil the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law. We will either delete it or aggregate it, or, if this is not possible then we will securely store your personal data and isolate it from any further processing until deletion is possible.

Data Subjects have certain rights in respect of their personal data. The rights given with respect to your personal data include:

  • The Right of Access: You have the right to access personal data and supplementary information. You can ask us for a copy of your personal information.

  • The Right to Erasure: You can ask us to erase or delete all or some of your personal information (e.g., if it is no longer necessary to provide Services to you) without undue delay.
  • The Right to Restriction of Processing: You can ask us to stop using all or some of your personal information (e.g., if we have no legal right to keep using it) or to limit our use of it (e.g., if you think your personal information is inaccurate or unlawfully held).
  • The Right to Data Portability: You have the right to data portability which provides the right to receive your personal data in a structured, commonly used and machine-readable format, and have the right to transmit the same to another controller.
  • The Right to Object: You have the right to object to the processing of personal data.

  • The right to lodge a complaint: You have the right to lodge a complaint with the supervisory authority if you are dissatisfied with the way we handle or process your personal data.

We strive to give you ways to access, update/modify your data quickly, or delete it unless we have to keep that information for legal purposes. These rights can be exercised by contacting us using the details set out in the “Contact Information” section below. 

Notice to California Individuals

California residents have a legal right to request organizations to tell them how their Personal Information has been shared, if at all, with third parties for the third parties’ direct marketing purposes. To make such a request, please reach us at the contact information listed below. This request may be made no more than once per calendar year, and we reserve our right not to respond to requests submitted other than to the email or mailing addresses specified below.

Do Not Track

Certain web browsers and other devices you may use to access the Sites may permit you to submit your preference that you do not wish to be “tracked” online. We do not currently commit to responding to “do not track” requests, in part, because no common industry standard for “do not track” has been adopted by industry groups, technology companies, or regulators. We will make efforts to monitor developments around Do Not Track browser technology and the implementation of a standard. 

Sale or Sharing of your personal information

Atidiv will not Sell or Share Customer Personal Information under the Agreement. 

Use of sensitive personal information

Atidiv does not collect any Sensitive Personal Information from the Customers under the Agreement. 

Retention, Use, Disclosure of Personal Data

Atidiv will not retain, use, or disclose Customer Personal Information according to the Agreement outside of the direct business relationship with Customer or for any purpose, including a Commercial Purpose, other than as necessary for the specific purpose of providing the Products for Customer according to the Agreement, or as otherwise set out in the Agreement or as permitted by the CCPA.

Your California Privacy Rights

In addition to rights of access, correction, and deletion, as described above, California Consumers may have certain additional rights in connection with the personal information we collect about you, many of which are subject to exceptions under applicable law: 

– The right to access and disclosure and portability:  You may have the right to request, twice during a twelve-month period, the following information about the personal information we have collected about you. 

  • the categories and specific pieces of personal information we have collected about you; 
  • the categories of sources from which we collected the personal information; 
  • the business or commercial purpose for which we collected or sold the personal information; 
  • the categories of third parties with whom we shared the personal information; 
  • the categories of personal information that we sold or disclosed for a business purpose, and the categories of third parties to whom we sold or disclosed that information for a business purpose; and 
  • the specific pieces of personal information we obtained from you in a format that is easily understandable, and to the extent technically feasible, in a structured commonly used, machine-readable format. 

– The right to non-discrimination: We will not deny, charge different prices for, or provide a different level of quality of goods or services if you choose to exercise these rights. Changes to Privacy Policy
